Terms of Use of the website przemienniki.net / repeate.rs

These Terms of Use define the rules for using the przemienniki.net / repeate.rs website (hereinafter referred to as the “Website”). By using the Website, you accept the provisions of these Terms of Use.

1. General Provisions

  1. The operator and owner of the Website is the Polski Związek Krótkofalowców (PZK) (Polish Amateur Radio Union) with its registered office in Warsaw at ul. Augustyna Kordeckiego 66 lok. U1, KRS: 0000088401 (hereinafter referred to as the “Operator”).
  2. The Website is non-commercial, community-driven, and informational. Its primary goal is to maintain an up-to-date database and map of amateur radio repeaters for the benefit of the amateur radio community.
  3. The use of the basic functions of the Website (browsing the map, searching repeaters, reporting updates) is free of charge.

2. Conditions of Use of the Website

  1. The User agrees to use the Website in a manner consistent with the law, rules of social conduct, amateur radio ethics, and these Terms of Use.
  2. It is forbidden to take any actions that may disrupt the proper functioning of the Website, in particular overloading the network infrastructure or attempting unauthorized access to the code and database.

3. Reporting Changes and Content Rights

  1. Users can submit proposals for changes and updates to repeater data using a dedicated form.
  2. By submitting data, the User declares that it is consistent with the facts and that its publication on the Website does not violate the rights of third parties.
  3. By submitting technical data of a repeater, the User grants the Operator a free, time- and territory-unlimited license to publish, modify, and share it within the Website.

4. Database Protection and Prohibition of Scraping (Data Downloading)

  1. The database of amateur radio repeaters made available on the Website constitutes a database within the meaning of the Act of July 27, 2001 on the Protection of Databases and is subject to full legal protection. Its producer and the entity entitled to dispose of it is the Polski Związek Krótkofalowców.
  2. It is forbidden to automatically download (so-called scraping), systematically or secondarily use, or extract all or a substantial part of the data from the Website database for use in any external applications, systems, or services that are commercial or for-profit.
  3. Commercial or for-profit activity includes, in particular:
  • Publishing paid applications in app stores (e.g. Google Play, Apple App Store, Microsoft Store).
  • Projects and applications that are funded or supported through micropayments, donations, or community crowdfunding (e.g. Patronite, BuyCoffee, Ko-fi, PayPal, ads on the site/in the app).
  • Any use in systems of third-party companies, commercial radio networks, and paid services.
  1. The use of data from the Website database in external applications and websites is allowed only if one of the following conditions is met:
  • Private use: The data is downloaded and used solely by a single user for personal purposes, without public distribution.
  • Fully Open-Source Projects: The application or service using the data is fully non-commercial, and its complete source code is published under a free license (e.g. GPL, MIT, Apache) allowing anyone to freely run, compile, modify, and distribute it without any fees, license restrictions, or legal consequences. The author of such a project may not derive any profit from it, including community funding (crowdfunding, donations, sponsorships).

5. Liability

  1. The technical data presented on the Website is for informational purposes only and is created based on community reports and official lists of radio licenses. The Operator makes efforts to keep the data up to date, but does not guarantee its accuracy.
  2. The Operator is not liable for:
  • Damages resulting from the use of incorrect information contained on the Website.
  • Interruptions in the availability of the Website caused by technical reasons or force majeure.
  • Violations of the law or radio permits by users using transmitting and receiving equipment on the frequencies listed on the Website.

6. Final Provisions

  1. The Operator reserves the right to unilaterally change these Terms of Use. Changes come into force on the day of their publication on the Website.
  2. In matters not covered by these Terms of Use, the relevant provisions of Polish law shall apply, including the Civil Code and the Act on Copyright and Related Rights.
  3. Any disputes shall be resolved by the common court having jurisdiction over the registered office of the Operator.
